An auxiliary nurse, Jimoh Ismail, has been charged before a Lagos high court sitting in Ikeja, for failing to prevent an illegal abortion for one Joy Endurance. The court is presided over by Justice Kudirat Jose.
The defendant, through his counsel, Mr. Dele Oloke, informed the court that the abortion which led to the death of Endurance was conducted by Dr. Lekan Wahab, who is still at large.
At the resumed hearing, a prosecution witness, Inspector Solomon Ojo-Oni, explained that although the Director of Public Prosecutions, DPP, advice stated that the said abortion was carried out by Wahab, it was the defendant who did the abortion.
“The defendant claimed not to be the one that did the abortion. But one Blessing Edet, in her statement, said the defendant had earlier performed an abortion on her. It was Blessing that brought the deceased to the defendant for the abortion. I have spent 10 years in the homicide section of Panti and I have 25 years experience in the police force,” Inspector Ojo-Oni said.
The witness told the court that no autopsy was conducted on the corpse, but a thorough investigation was carried out.
Ojo-Oni noted that the deceased was five months pregnant before she was taken to the defendant for abortion, adding: “Endurance died two weeks after the abortion due to complications.”
He further explained that the reason the police later decided to use its third suspect (Blessing) was because she brought the deceased to the defendant and she too had an abortion through the same defendant.
“But now, Blessing cannot be reached. Each time we call her number, the response we get is that it is not reachable. When it became obvious that we cannot reach Blessing anymore, the only thing we did was to inform the prosecutions counsel,” Insp Ojo-Oni added.
During cross-examination, the defence counsel asked the witness why an autopsy was not carried out on the deceased, he answered: “The pathologist did not carry out the autopsy since the statement of Blessing showed that she took the deceased to the defendant.”
After listening to Insp Ojo-Oni, the presiding judge, Justice Kudirat Jose, adjourned to September 25 for arguments of no case submission
